I got so worked up over the Christopher Handley case lately, but I think these guidelines will help future illustrators and manga readers:

I personally don't think this is right, but these guidelines will help with future events.

No character who appears to be under 18 shall be depicted in sexual situations that includes physical contact of either:
genitals to anal,
genitals to genitals (breasts included as genitals),
oral to anal, or
oral to genitals weather of same or opposite gender.

This excludes hand to genital,
hand to oral, or
hand to anal activities.

Sex may be defined as penetration of character or a forced sexual encounter.
This excludes consented non penetrating acts.

Sexual activity may include masturbation, but a girl moving her hand under her panties isn't masturbation until she fingers herself.
Male masturbation can't be proven if the picture is cropped or the image is obscured or censored.

A stiffer (no pun intended) fine is given if a genital or pubic area is seen during the act, however nudity (in full or in part) is not fined if sexual activity as defined above does not take place.

My own opinion, it's art pure and simple.
Americans shouldn't be punished for Japanese illegal activity (shipping lolicon and shotacon out of Japan).

Bestiality contains the above with animals.
Laying naked among a lion's fur is not punishable by any means.
Riding or petting a Zebra naked is also not an offense.

To be child pornography, a reasonable person must not be able to distinguish the image from real life (which excludes lolicon and shotacon from a child porn offense), however if challenged, the above workarounds may apply.

The prohibitions against computer-generated and illustrated child pornography have also been previously ruled unconstitutional by the Supreme Court, when they were included in the Child Pornography Prevention Act of 1996.
